As a coach, my responsibility is to help you in your efforts to achieve the health related goals and results that you seek. As the Client, your responsibility is to enter this relationship as an active participant in achieving those stated goals. Coaching results are not guaranteed and results vary greatly depending on the time and effort the Client puts into the program.
The Client understands that the role of the Coach is not to diagnose or treat any medical conditions (which should be treated solely by the Client's professional medical staff). The Client understands that the Coach is not acting in the capacity of a medical doctor or other medical health care provider. Any advice given by the Coach is not meant to take the place of advice by these professionals. Client understands that the Coach is a functional nutrition health coach offering motivational and educational services. Client waives any right to hold Company or Coach liable for any advice, suggestions, recommendations, or guidance provided.
If the Client is under the care of a health care professional, the Client is advised to discuss any Company recommendations that may impact such care, and, to disclose to Coach and Company all such applicable recommendations, and, to comply with all such recommendations.
The Client acknowledges that the Client takes full responsibility for all presently existing or future sustained medical conditions or problems.
The Client expressly assumes the risks of the Program, including trying new foods, and the risks inherent in making lifestyle changes. The Client releases the Coach and Company from any and all liability, damages, causes of action, and claims unless arising from gross negligence of the Coach or Company.
The Coach and Company will keep the Client's information confidential unless Client presents a danger to Client or others. In that case, Company may inform legal authorities so that protective measures can be taken. In addition, such confidential agreement shall not prevent Coach or Company from testifying or providing information demanded in any court or administrative proceeding.
In the event that there ever arises a dispute between Coach or Company and Client, such dispute shall be resolved before the American Arbitration Association. Any judgement or the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof and shall be final and binding upon the parties. Such arbitration shall be conducted in accordance with the rules of the Association.
